Medical, Hospital & Nursing Home Malpractice & Wrongful Death
Medical Malpractice is the negligent or careless action or
inaction by a doctor, nurse, hospital, chiropractor, nursing home,
anesthesiologist, pharmacist, therapist, dentist, or other licensed medical or
other health care provider that results in harm to a patient. As reported in
Medical News Today, medical errors are the fifth-leading cause of deaths in the
United States, with up to 98,000 deaths annually. Researchers report that
roughly five to ten percent of all patients will fall victim to medical
negligence. While an injury or death may result from medical, hospital or
nursing home negligence, it is important to remember that not all medical
situations that end badly are caused by malpractice.
The failure by a provider to follow accepted professional
standards of care - what a reasonable provider should do - is the basis of most
medical negligence claims. A patient signing a consent form does not ordinarily
allow a health care provider to avoid medical malpractice liability.
Determining if you have a potential case for medical,
hospital or nursing home negligence requires careful study and analysis. Gray,
Ritter & Graham provides a staff of experienced medical and legal professionals
who help clients determine whether an injury, or the death of a loved one, is
the result of medical, hospital or nursing home negligence. If there is evidence
of a medical, hospital or nursing home error, our medical malpractice attorneys
will marshal necessary records and other evidence to determine whether you have
a meritorious claim. If we mutually agree to go forward with litigation, we will
secure the experts required to substantiate your claim and we will represent you
every step of the way. Our singular goal is to guide your case to a successful
conclusion - which is what we have been doing for our clients for over sixty
years.
There is no simple way to present a formula for all medical,
hospital and nursing home malpractice cases. Every medical negligence case is
unique, with its own details, facts, complications, and circumstances. Following
are some examples of situations that frequently involve medical, hospital, or
nursing home negligence or malpractice:
-
Failure to perform medical procedures in a competent
manner
-
Failure to order necessary tests or adequately evaluate
the results of those tests
-
Improper emergency room treatment
-
Misdiagnosis or failure to diagnose a medical condition
-
Injuries caused by improper administration of anesthesia
-
Failure to properly monitor an expectant mother or a
fetus
-
Improper administration of prescription or
non-prescription drugs

Injury to mother or child during a vaginal birth after
C-section

devices

A young mother was convicted of first degree murder and sentenced to life in
prison without the possibility of parole for the alleged poisoning death of her
infant son with antifreeze. After the conviction, GRG agreed to represent the
mother and her husband. The conviction was overturned and the mother was
released from prison. A wrongful death claim was then successfully pursued
against a hospital, physicians and commercial laboratory by proving the baby was
never poisoned. Instead, the evidence established their cumulative failures to
make a proper diagnosis of an inborn metabolic disease known as methylamonic
acidemia that, if treated properly could have saved the baby's life. This case
was ultimately the subject of many medical articles, documentaries, and a
made-for-television movie, "Without a Kiss Goodbye".
